NASHVILLE, Tenn. (WTVF) — A 27-year-old Nashville man is suing the city, an apartment complex, and contractors after a crash in May left him paralyzed.
Daniel Freeman collided with a guardrail on Pin Hook Road, and his attorneys allege it was improperly installed, exacerbating his injuries. Josh Moore, an attorney representing Freeman, stated, “This crash could have been deadly because the guardrail was allegedly installed wrong.”
According to Moore, the faulty guardrail pierced Freeman’s windshield and struck him, resulting in life-altering injuries. “The guardrail, coming through the engine block and impacting the passenger, caused catastrophic injury,” Moore added.
Tennessee has stringent guardrail requirements meant to improve safety, particularly after 17-year-old Hannah Eimers died in a 2016 crash involving an outdated X-Lite guardrail. Following her death, the Tennessee Department of Transportation removed X-Lite guardrails statewide and implemented new safety regulations.
Despite these efforts, Moore noted that dangerous guardrails remain in Davidson County, urging for their rectification.
Freeman, an aspiring songwriter, is currently awaiting surgery with hopes to regain some use of his hands but has lost function in his legs and arms.
